    5) How is the Rospotrebnadzor inspection carried out?

    During the inspection, the Rospotrebnadzor inspector is required to introduce himself, present his official identification and an order to conduct an inspection, signed by the head of the territorial body of Rospotrebnadzor. The order must also indicate the details of the inspectors authorized to conduct the inspection, the start and end dates of the inspection, and the address at which the inspection will be carried out.

    Upon written request of the inspector, he must be presented with all the necessary documents. For failure to comply with the requirements of the Rospotrebnadzor inspector during an inspection, the organization (entrepreneur) bears administrative responsibility under Part 1 of Article 19.4 of the Code of Administrative Offenses of the Russian Federation. Therefore, if any documents are missing from the organization, it is necessary to notify the inspector about this in writing.     6) Limitation of the period for conducting an inspection by Rospotrebnadzor.

    The inspection period cannot exceed 20 working days and can only be extended in exceptional cases by decision of the head of the territorial body of Rospotrebnadzor. The Rospotrebnadzor inspector is obliged to inform the legal representative of the organization about the decision to extend the inspection period.

    For small enterprises, the duration of a scheduled inspection cannot exceed 50 hours, and for a micro-enterprise - 15 hours per year. This exception applies only to scheduled on-site inspections of Rospotrebnadzor. When conducting a documentary or unscheduled inspection, the general period (20 working days) applies.

    Please note that when calculating the period of an inspection, it is necessary to sum up the time of all inspections (inspections carried out by all supervisory authorities in relation to the organization (entrepreneur) for the year.

    7) Registration of the results of the Rospotrebnadzor inspection.

    Based on the results of the inspection, the Rospotrebnadzor inspector draws up an act in two copies, one of which is given to the head of the organization (entrepreneur), their legal representatives against signature, or (if it is impossible to deliver the act) sent to the organization (entrepreneur) by registered mail with acknowledgment of receipt.

    In case of disagreement with the facts reflected in the inspection report of Rospotrebnadzor, you can submit written objections to it within 15 days from the date of its delivery. Objections may be accompanied by documents confirming their validity, as well as audio and video recordings, employee explanations, etc. Objections are considered by the head of the territorial body of Rospotrebnadzor or his deputy within 30 days, after which a reasoned decision is made. The decision made is reported to the organization (entrepreneur) that filed the objections.

    If violations are identified based on the results of the inspection, Rospotrebnadzor initiates a case of an administrative offense and issues a binding order to eliminate the identified violations.

    8) Measures to respond to violations identified during the inspection.

    If violations are revealed during an inspection, the Rospotrebnadzor inspector has the right to:

    Initiate a case of administrative violation. From the moment the Rospotrebnadzor inspector makes a determination (in some cases, from the moment the protocol is drawn up), a case of administrative offense is initiated. To draw up a protocol, the Rospotrebnadzor inspector is obliged to invite the entrepreneur to the premises of the territorial body of Rospotrebnadzor, having previously notified the date, place and time of its preparation. After drawing up the protocol, a consideration of the administrative case on the merits (making a decision) is scheduled. Based on the results of the consideration of the case, a decision is made to impose punishment.

    The decision to prosecute can be appealed to the arbitration court within 10 days from the date of its delivery.

    Issue an order. The order contains requirements to eliminate violations identified during the inspection and must be fulfilled within the time period established therein. For failure to comply with an order, an organization (entrepreneur) may be held liable under Article 19.5 of the Code of Administrative Offenses of the Russian Federation.

    The order of Rospotrebnadzor can also be appealed in court.

    Draw up a protocol on a temporary ban on activities. A copy of the protocol on the temporary ban on activities is handed over to the legal representative of the organization. A temporary ban on activities is a measure to ensure proceedings in an administrative case. The validity and legality of the application of a temporary ban on activities can be verified by the court upon the application of the organization (entrepreneur) in respect of which it was established.     9) Restrictions on inspection by Rospotrebnadzor.

    Law No. 194-FZ establishes the following restrictions when checking Rospotrebnadzor:

    1. check compliance with requirements that are not within the competence of Rospotrebnadzor.
    2. carry out an inspection in the absence of the head of the organization, the entrepreneur, or their authorized representatives.
    3. demand the provision of documents not related to the subject of the inspection.

    • correct execution of employee work books and contracts;
    • availability of documentation confirming the qualifications of employees (copies of educational documents);
    • availability of medical books for employees;

    Documents provided to SES inspectors

    During the inspection, inspectors note the presence of:

    • signs in accordance with the requirements;
    • corners of consumers (clients, patients);
    • prices for goods or services provided, signed by the manager;
    • certificates of ownership of the premises or lease agreements;
    • contracts for waste removal and disinfection, disinfestation, and deratization;
    • charter of the organization, certificate of assignment of TIN;
    • logs of sanitary inspections, sanitary-epidemiological and expert opinions;
    • business licenses and other documents.

    It should also be said that the requirements for mandatory documentation may differ depending on the region.

    SES inspectors evaluate all provided documentation from the point of view of legality, compliance with regulations and regulations.

    Powers of the SES based on the results of the inspection

    Based on the results of SES inspections, conclusions are issued indicating the violations identified, measures are proposed (recommendations are given) to eliminate them, and orders are issued regarding the punishment of those responsible.

    In case of failure to comply with the requirements of the inspectors, the heads of organizations (entrepreneurs) are held administratively liable in accordance with the law (Part 1 of Article 19.4 of the Code of Administrative Offenses of the Russian Federation).

    This provision provides for a fine, the amount of which for officials varies from 2,000 to 4,000 rubles.

    What is beyond the competence of the SES?

    The powers of the SES are not unlimited. For example, inspectors are not entitled to:

    • carry out a scheduled inspection without the presence of officials or persons who are representatives of the legal entity in respect of which it is being carried out (with the exception of cases when there is a threat to the health and life of citizens, representatives of fauna and flora, state security or in the event of man-made disasters);
    • seize original documentation or demand documents, information or samples of products that are not the objects of inspection;
    • exceed the inspection deadlines provided for by current legislation;
    • take samples (samples) of products for further research or examination in excess of the norms established by the standards and without drawing up the relevant documents (sampling acts);
    • issue instructions to organizations and individual entrepreneurs regarding the conduct of control measures at their expense.

    SES control body

    Checks of documents and sanitary and hygienic conditions are carried out by the control body of the SES. First of all, we note that each type of enterprise requires its own list of documents. Accordingly, an inspection of SES products and an inspection of a law firm’s office will be somewhat different in terms of the requirements for the organization. The SES can check everything from personnel medical records to statutory documents.

    Scheduled inspections of SES

    A scheduled SES inspection usually takes place after the company is notified of the inspection and a specific date is set. According to the 2017 SES inspection schedule, scheduled inspections for companies are carried out every 3 years (with the exception of medical organizations) or in the event of notification of a new type of activity.     Scheduled inspections are carried out on the basis of an annually drawn up plan (schedule), which can be viewed on the official websites of the territorial bodies of this department and prosecutor's offices in the regions. The plan contains the following data:

    • date of inspection;
    • its duration;
    • persons in respect of whom the inspection will be carried out;
    • subject of inspection.

    In accordance with the law on the protection of the rights of entrepreneurs during inspections, a legal entity must be notified of the planned inspection at least 3 days before it begins. The inspection body notifies legal entities of planned actions as follows:

    • by post with acknowledgment of receipt;
    • personal delivery of the notice to the legal representative of the legal entity against signature.

    Such checks are carried out at least every 3 years:

    • after registration of a legal entity;
    • start of business activities;
    • from the date of completion of the previous inspection.

    Unscheduled inspections of SES

    Please note that since 2015, the SES has the right to conduct unscheduled inspections. This applies to catering organizations, manufacturers and sellers of food products. There are several reasons for this type of check:

    • complaint from consumers, authorities and local government employees
    • poor quality of services or products

    During such a check, as a rule, the information received is proved or disproved. But even during unscheduled inspections, the manager of the enterprise is notified at least 24 hours in advance, unless there is an emergency case of poisoning or serious infections.

    Unscheduled inspections can be carried out:

    • upon expiration of the deadlines established for the execution of previously issued orders;
    • when territorial SES bodies receive applications reporting facts that pose a threat to the life and health of citizens and the environment;
    • in cases of violation of consumer rights.

    If the appeals of individuals and legal entities do not indicate specific facts of violations or they are submitted anonymously, then the inspection will be refused. It should also be mentioned that an unscheduled inspection is possible only with the consent of the prosecutor's office, which is the supervisory authority. Otherwise, its results will be considered invalid.

    Exceptions are allowed in cases where the SES receives emergency messages about situations that pose a threat to the life and health of people, flora and fauna, objects of historical value, or the security of the country.

    The legal entity should be notified of the upcoming inspection no later than one day before it begins. In emergency cases, this requirement may not be observed.

    On-site and documentary checks

    On-site and documentary inspections can also be scheduled or unscheduled.

    In the first case, in addition to documentation, goods, equipment, premises and territories are inspected.

    In the second, the inspection is carried out without visiting the site, while the necessary documents are provided to the SES by a legal entity. If it reveals serious violations, then an on-site inspection may be scheduled. During the documentary inspection, it is allowed to examine both documentation and product samples.

    SES penalties

    SES fines may affect you if any violation is detected. Depending on the nature of the violation, there may be orders to correct violations, a monetary fine, suspension of the company’s activities for up to 90 days, and even criminal liability in particularly serious cases.     • Only the head of the company or an authorized representative can represent the organization during the inspection of the SES. If at the time of the inspection the manager or authorized representative is absent, the company has the right to refuse the inspection to the SES employees. However, this rule should not be abused.
    • Check the officials' documents. If there are any violations in them, then this is also the right to refuse an inspection of your organization by these SES employees.

    • When checking, do not worry, behave as you would on a normal day. There is no need to imagine the SES inspection as a terrible monster. These are ordinary people who want to do their job well.
